Ignore the court at your peril

A hospital consultant Essam Ali was ordered to pay all his assets worth £550,000 to his wife in a controversial case.
The husband left his family and moved abroad to Bahrain and has not paid a penny in maintenance or child support since 2012.
Out of the reach of the Child Support Agency and the British Courts it was feared that the doctor, described as a ‘serial defaulter’, would never contribute to payments to support he and his two children.
The Court of Appeal upheld the Family Court decision but it was described as an extraordinary departure from reality.
The Appeal judge Lord Justice McFarlane said:
“Looking to the future, there was no expectation that she could look to him for any future payment of maintenance and it was therefore necessary for her to achieve an aware representing effectively most of the capital assets.”
It is exceptional but not unique for one side in a divorce case to receive 100% of their assets. Contact our Family Law department for advice that could improve your situation.
