Given the nature of the allegations and the length of time involved, our team recognised early on that meticulous analysis of the available material would be crucial. Part of the prosecution’s case relied on telephone evidence, and so we undertook a comprehensive examination of all relevant digital communications.

What our team discovered during this process was highly significant as key inconsistencies emerged from complainant’s statement. These inconsistencies cast serious doubt on the reliability of the account provided. With this in mind, we instructed leading forensic experts to assist with a detailed analysis of the complainant’s mobile device.

Initially, access to this device was resisted. However, our persistence, grounded in sound legal argument and supported by appropriate court applications, ultimately led to the disclosure of the device and the data it contained. Our expert’s report, encompassing both visible and deleted messages, became a pivotal part of the defence strategy which focused on dishonesty.

At trial, this preparation proved vital. The barrister, fully briefed and supported by the depth of work undertaken in advance, was able to present a compelling defence that systematically challenged the credibility of the allegations. The result was swift: the jury returned not guilty verdicts on all counts.
